What is a Serial Family Violence Offender (SFVO)?
An SFVO is someone declared by a court to have a pattern of committing family violence offences.
This declaration carries serious legal consequences, including mandatory electronic monitoring.
If you are declared an SFVO, you may face:
Mandatory electronic monitoring during bail, sentencing, or parole (unless exceptional circumstances apply).
Ineligibility to hold a firearms or explosives licence.
Stricter conditions for community-based sentences and parole.
A court may declare you an SFVO if you are convicted of a family violence offence and you have at least:
Three (3) prior prescribed offences, or
Two (2) prior indictable-only prescribed offences
Note: The offences must have occurred on different days within 10 years.
Does the court have to make the declaration?
No. Even if you meet the criteria, the court has discretion and must consider factors like your criminal history, the seriousness of past offences, and the risk of reoffending. Legal representation is essential here.
Yes. You can respond in court by checking your record, disputing incorrect facts, and providing evidence or expert reports. If declared, you may apply to cancel it after 10 years.
